Terms & Conditions

These terms apply when you use mydigital.company, request a quote, or engage MYDIGITALCOMPANY for website development or website care. MYDIGITALCOMPANY is owned and operated by Theresa Grainger as an individual (sole proprietor) based in Paarl, Western Cape, South Africa.

This website provides general information about website development and optional weekly website care. Content may be updated without notice and is not professional legal, financial or technical advice. Please also read the Website Disclaimer.

Services and pricing

Package prices shown on this website are starting prices, not final quotations:

  • Simple Website — from R2,000. Optional Website Care: R200 per month.
  • Business Website — from R4,000. Optional Website Care: R400 per month.
  • Advanced Website — from R8,000. Optional Website Care: R800 per month.

The final price depends on the agreed functionality, content, number of pages, number of products, integrations and overall complexity. The final project price is confirmed in a written quotation before development begins. A “fixed quote” means the price is fixed for the scope described in that quotation; it does not include every possible future request.

Project process

  • Share what you need.
  • Receive a fixed quote for the agreed scope.
  • Confirm with a deposit.
  • Design & build.
  • Launch & hand-over.

No work starts until all three of the following are in place: (1) the written quote is accepted, (2) the project agreement is signed, and (3) the required deposit has been received. Project-specific written terms take priority if they differ from these website terms.

Deposits

A deposit secures your project and your booking in the work schedule, and covers the time and work undertaken during the development process. The required deposit depends on the package:

  • Simple Website — R250 deposit.
  • Business Website — R500 deposit.
  • Advanced Website — R1,000 deposit.

Once work has commenced, the deposit is non-refundable. This applies subject to applicable South African consumer law, and nothing here removes rights that cannot lawfully be excluded.

Final payment

The remaining balance is payable within 30 days of the finished website being completed and made ready for hand-over or launch. It is the client's responsibility to ensure payment is made within the agreed period.

If the outstanding balance is not paid within the agreed period, MYDIGITALCOMPANY may, after reasonable notice, suspend work or take the website offline until the account has been brought up to date. Any statutory rights you have remain unaffected.

Refunds

  • Deposits are non-refundable once work has commenced, subject to applicable law.
  • Once a project has been completed, approved and/or delivered, payments are generally non-refundable where the agreed service has been supplied.
  • Nothing in these terms excludes or limits consumer rights that cannot legally be excluded under South African law.

Client responsibilities

To keep your project on track, you are responsible for supplying:

  • accurate business information;
  • text and content;
  • logos and branding files;
  • images;
  • product information and pricing; and
  • contact details and any other materials required for the project.

You confirm that you hold the necessary rights, licences or permissions for all content you supply. MYDIGITALCOMPANY is not responsible for legal problems arising from content supplied by the client. Delays in supplying materials may affect timelines.

Changes to scope

Requests that fall outside the agreed quotation or project scope may result in additional charges. Where reasonably possible, additional work will be quoted or agreed in writing before it is undertaken. A “fixed quote” fixes the price for the agreed scope only — new requests after sign-off are quoted separately.

Reviews and revisions

Each project includes two reasonable rounds of revisions within the agreed scope, so you can refine the design and content before launch. Further changes, redesigns or additions beyond the agreed scope are quoted and charged separately. Timelines depend on prompt feedback and content from you; extended delays in supplying materials or approvals may move the delivery date.

Intellectual property and ownership

  • Content, logos, branding, images and product information supplied by the client remain the client's property.
  • Design work and website code created by MYDIGITALCOMPANY for your project transfer to you as a licence to use for your business once the project has been paid in full.
  • Third-party software, open-source components, stock assets, fonts, plugins, APIs, hosting services and domains remain the property of their respective owners and are provided under their own licences and terms. MYDIGITALCOMPANY does not claim ownership of these and cannot transfer rights it does not hold.
  • Reusable tools, templates, techniques and general know-how developed by MYDIGITALCOMPANY remain its property and may be reused on other projects.

Portfolio

Completed projects may be displayed in the MYDIGITALCOMPANY portfolio, website, social media or marketing materials, unless you request in writing that your project not be displayed. Portfolio use will not disclose confidential client information unnecessarily.

Website Care

Website Care is an optional monthly service billed monthly, with work checked and handled on a weekly basis:

  • Simple Website Care — R200 per month.
  • Business Website Care — R400 per month.
  • Advanced Website Care — R800 per month.

Each plan includes:

  • a weekly technical check of the website;
  • applying text, image or product updates you send;
  • regular search-friendly blog posts or page updates;
  • basic technical SEO improvements; and
  • security and performance maintenance.

Website Care does not automatically include major redesigns, new functionality, major development projects, large-scale product uploads or any work outside the agreed service scope. Such work is quoted and charged separately.

Cancelling Website Care

Website Care may be cancelled by either party on 30 days' written notice. Care continues, and remains payable, during the notice period. After cancellation, weekly checks, updates and content work stop, and any third-party services you pay for directly (such as hosting or domains) remain your responsibility. Cancelling Website Care does not affect your ownership of a website that has been paid for in full.

No guaranteed results

MYDIGITALCOMPANY cannot guarantee specific sales, leads, revenue, search rankings, traffic or conversion rates. Results depend on many factors outside MYDIGITALCOMPANY's control, including market conditions, competition, pricing and search-engine algorithms.

Third-party services

Websites may rely on third-party services such as hosting providers, domain registrars, payment providers, analytics services, APIs and other external services. These are governed by their own terms and pricing. MYDIGITALCOMPANY cannot guarantee uninterrupted availability, performance or continued existence of third-party services.

Acceptable use of this website

You may not use this website to:

  • break any law or infringe another person's rights;
  • send malicious code, spam or misleading information;
  • attempt unauthorised access to the website or its supporting systems; or
  • interfere with the website's availability, security or operation.

Limitation of liability

To the extent permitted by law, MYDIGITALCOMPANY is not liable for indirect or consequential loss, loss of profit, loss of data or business interruption arising from the use of this website, the services, or any third-party service. Where liability cannot be excluded, it is limited to the amount paid for the specific service concerned. Nothing in these terms is intended to exclude or limit liability or consumer rights that cannot legally be excluded under South African law.

Consumer rights and applicable law

These terms operate subject to applicable South African law, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, the Protection of Personal Information Act 4 of 2013 and the Promotion of Access to Information Act 2 of 2000. No attempt is made to contract out of statutory consumer protections.

Disputes

If something goes wrong, please contact Theresa Grainger first at graingertheresa87@gmail.com so the matter can be resolved directly and promptly. If the matter cannot be resolved within a reasonable time, the parties may agree to mediation before taking further steps. These terms are governed by the laws of the Republic of South Africa, and disputes are subject to the jurisdiction of the competent South African courts. Consumer remedies available under South African law remain available to you.

Privacy

Personal information is handled as explained in the Privacy Policy. Access requests are covered by the PAIA Manual.
